Domain name registration data policy and procedures

Who we are and scope

Günther Mair, sole proprietorship based at Andrianer Str. 7/g, 39010 Nalles/Nals (BZ), Italy, VAT no. IT02509280216, provides domain name registration services:

• as a registrar accredited with Registro .it, for .it domain names;
• as an intermediary of the registrars Vautron Rechenzentrum AG and Key-Systems GmbH, for domain names under other top-level domains.

Registration requests reach us directly from customers or through our resellers. In all cases this policy applies to the registration data of the domain names we manage.

Legal basis: Article 29 of Legislative Decree 138/2024, transposing Article 28 of Directive (EU) 2022/2555 (NIS 2).

Data collected

For each domain name we collect and maintain, with due diligence, at least the following data:

• the domain name;
• the date of registration;
• the name, contact email address and telephone number of the registrant;
• the contact email address and telephone number of the point of contact administering the domain name, where different from those of the registrant.

We also collect the data required by the Registro .it regulations or by the terms of the responsible registrar (e.g. postal address, tax code or VAT number). Personal data are processed in accordance with Regulation (EU) 2016/679 (GDPR); our privacy notice is available in the corresponding Privacy section.

Verification of data

• At registration: before submitting data to Registro .it or to the registrar, we check that they are complete and formally correct (format of email address and telephone number, tax code or VAT number, consistency of address and registrant type). A domain name is not registered with incomplete or manifestly incorrect data.
• Requests via resellers: the reseller collects the data from its customer and is required to pass them on to us correct and complete. We nevertheless carry out the check described above before registration.
• At every change and every renewal: we repeat the check on new or changed data.
• Upon notice: if we are notified of inaccurate data (by authorities, by third parties or through undeliverable messages), we ask the registrant to correct or confirm the data within 15 days. Failing that, we apply the measures provided for by the Registro .it regulations or the registrar’s terms, which may include suspension of the domain name.

In addition, Registro .it and the registrars carry out their own checks under their respective rules.

Publication of data that are not personal data

Without undue delay after registration, registration data that are not personal data are made publicly available through the lookup services (WHOIS/RDAP) of Registro .it for .it domain names and of the registrars Vautron Rechenzentrum AG and Key-Systems GmbH for other domain names.

Access to data by legitimate access seekers

Access seekers that are legitimate under Union or national law (e.g. competent authorities, judicial and law enforcement authorities, CSIRTs) may request access to specific registration data.

• Channel: a reasoned request sent by certified email (PEC) to guenther.mair@pec.it.
• Content of the request: identity and capacity of the requester; legal basis of the entitlement; domain name(s) concerned; data requested; grounds and purpose of the request.
• Reply: without undue delay and in any case within 72 hours of receipt of the request. The reply contains the requested data or the reasons why the request was not considered legitimate or duly reasoned.
• Record keeping: requests and replies are logged and retained.

Cooperation to avoid duplication

We collect the data once and transmit them to Registro .it or to the responsible registrar, which maintains them in its database. We coordinate collection and updating with Registro .it, the registrars and our resellers in order to avoid duplicate collection of data.

Review

This policy is reviewed at least once a year and whenever the law or the rules of Registro .it or of the registrars change. Questions: guenther.mair@pec.it.
